These are the rules for using Kindseal. We've kept them short and in plain words. Please read the section on payments being final before you publish.
About these terms
Kindseal (kindseal.com) is a website that offers a service. It's run by CariBoard Online (cariboard.com), registered in Trinidad and Tobago (“we”, “us”). By creating an account or using Kindseal, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use the service.
Your account
You must be at least 13, or the higher age of digital consent where you live, to create an account.
You sign in with a one-time link sent to your email. There is no password.
Anyone who can read your email can sign in to your account, so keep your inbox secure. You're responsible for what happens in your account.
One person per account. Please use an email address that is yours.
What Kindseal does
Kindseal lets you build a keepsake page for one person: for love, a birthday, a memorial, a wedding, a graduation or an occasion you name. Building and previewing a page is free. When you pay, we publish it at a private, unguessable link that opens with a wax-seal animation. You can add a passcode and have us email the link to the recipient, now or at a time you choose.
People who open the page can send you a private reply, post to a memory wall (shown only after you approve it) or light a memorial candle.
Price and payment
Publishing a page costs USD 10, paid once. There is no subscription.
An optional Edit Pass costs USD 3 and adds 3 more touch-ups and a fresh 30-day edit window to a published page.
Prices are in US dollars. Your bank may convert the amount to your card's currency and charge its own fees.
Payments are handled by WiPay on its secure page, and its terms also apply to the payment. We never see your full card details.
All sales are final
We don't offer refunds. What you buy is a digital service that we deliver immediately: as soon as your payment is confirmed, your page is published (or your Edit Pass is added).
By paying, you:
ask us to start providing the service right away, and
acknowledge that, because it is delivered straight away, you lose any right to cancel and get your money back once it has been delivered, including any “cooling-off” or withdrawal period.
Unpublishing or deleting a page, or having it removed for breaking these terms, doesn't lead to a refund. Building and previewing are free, so please check your page carefully before you pay.
Nothing in these terms takes away rights you have under consumer laws that can't be waived by agreement.
Changes after publishing
Before you publish, you can edit as much as you like. After publishing, you get 3 touch-ups within 30 days, and an Edit Pass adds more. The recipient's name and the occasion are fixed once the page is published.
Your content
You keep ownership of everything you put on Kindseal: words, photos, voice notes and other material. You give us permission (a licence) only to store, copy, adapt (for example, resize photos) and show it as needed to host and display your pages and run the service. This permission ends when you delete the content or your account, apart from short-lived copies such as caches.
You confirm that you have the right to use everything you add, and the permission of anyone whose words, image or voice you include where that's needed.
Kindseal isn't a backup service. Please keep your own copies of photos and recordings that matter to you.
Rules for pages and posts
Don't use Kindseal to make or share:
anything illegal, hateful or harassing;
sexual content involving minors, of any kind;
material you don't have the rights to, especially music, photos and voice recordings that belong to someone else;
content that pretends to be another person or organisation;
pages that target, shame or harass a private person.
Also don't try to break, overload or get around the security of the service, or access pages and accounts that aren't yours.
When we remove pages
If a page, post or account breaks these rules, we may take the page down, remove the content or close the account, without a refund. Where it's reasonable, we'll tell you why.
Anyone who posts on a page, for example a reply, a memory or a candle, must follow the same rules and is responsible for what they write. As the page owner, you can approve, hide or delete posts on your page.
Songs and videos embedded from YouTube or Spotify are provided by those services, and their own terms apply.
Keeping Kindseal running
We work to keep Kindseal and your pages online, but we can't promise the service will always be available or free of errors. We may change, improve or remove features over time.
Closing your account
You can stop using Kindseal and delete your account at any time. Deleting your account immediately deletes all of your pages, including live ones, with their photos, voice notes and visitor posts. It can't be undone, and it doesn't lead to a refund. You can also unpublish or delete a single page whenever you like.
Our responsibility to you
Kindseal is provided “as is”. As far as the law allows, we aren't responsible for indirect or unforeseeable losses, or for lost data or content, and our total responsibility to you for any claim is limited to the amount you paid us in the 12 months before the claim.
Nothing in these terms limits responsibility that can't be limited by law, such as for fraud, or for death or personal injury caused by negligence.
Changes to these terms
We may update these terms. We'll change the date at the top, and if a change matters, we'll tell you by email or on the site before it takes effect. If you keep using Kindseal after that, the new terms apply.
Governing law
These terms are governed by the laws of Trinidad and Tobago. If you live somewhere whose consumer laws give you extra protection or let you bring a claim in your local courts, those rights still apply.
